Terms and Conditions for Next Website in Poland

Terms and Conditions updated as of 01 June 2026



1. Who we are and our Contact Details

These terms and conditions (“Terms”) govern your access and use of this website (the “Website”), and the related products, services, content, and technology (which includes accessing, browsing, or registering to use the Website and purchasing goods via the Website). By accepting the Terms during registration of your account and/or before making an order, you confirm that you have read, understand, and accept the Terms, and that you are entering into a legally binding contract with Next, and are agreeing to comply with these Terms. If you do not agree with these Terms you must not register and/or make orders via the Website.

We may change these Terms in the following situations: (i) changes in law which directly impact the content of the Terms, (ii) obligation imposed by any authorities which require amendment to the Terms, (iii) functional and technological changes in provision of services or selling goods under the Terms, (iv) changes in the scope of the functionalities or services already provided, including amending them or implementing new functionalities or services, (v) improving security, (vi) editorial amendments.

If we make a change, we will inform you about that, with reasonable notice, not later than 14 days before entry of the change into force. If you do not agree to a change, you may close your account and stop accessing or using the Website. Your continued use or access of the Website after the change entered into force, means that you accept the change. The most recent version of the Terms is also available on the Website. Any amendments to the Terms shall not apply to the purchase orders already made unless directly required by applicable laws.


4. Orders on our Website

When your order for goods is accepted by Next, a contract is formed between Next and you when we despatch the goods you have ordered, and not before. A contract is not formed at the point in time that payment has been taken from you by Next, or at the point in time that you receive an email from Next acknowledging receipt of your order. Until the goods are despatched the order may not be accepted by Next, or may be cancelled by you. Once you have concluded a contract with us via our Website, we will provide you with confirmation of your order by e-mail. Please retain your order confirmation email for your records.

The offers on our websites are directed exclusively to consumers who make purchases for purposes not related to commercial or professional activity. All orders placed online with us must be for private, non-commercial purposes. We reserve the right to refuse service or to refuse to enter a contract for online purchases with any company or corporate entity. We do not facilitate corporate, commercial, or self-employed transactions online and we do not issue commercial VAT invoices (including those with a company NIP/Tax ID) for corporate use. The confirmation email you receive serves as your standard consumer receipt.


5. Prices & Availability

All prices shown are total prices in Polish Zloty (zł), including the applicable value added tax. In addition to price, shipping costs may be charged in accordance with section 7 below. All orders for products are subject to availability. We reserve the right to accept or reject orders. Prices of goods displayed in and ordered online may differ from prices in store.

You must provide your payment details at the time of placing your order. We will request payment for the full amount on confirmation of your order.


6. Customs Fees

Please note that all shipments to destinations outside of the UK may be subject to import duties and taxes, including VAT which are levied by the importing country at the time the shipment arrives in your country as well as customs clearance fees. Any such duties, taxes and fees are not included in the product price or shipping costs and must be borne additionally by you. Please refer to your customs department or carrier for guidance.


7. Delivery Charges

Shipping is currently free for all orders over 149 PLN. Orders under 149 PLN will be charged at 15 PLN for shipping per order. Estimated delivery lead times will be confirmed at checkout. Please allow extra days for delivery during German holidays, UK national holidays, weekends, sale times & during strike actions.

Parcel Shop Delivery:
At the checkout page, choose 'Collection' and select your chosen pickup point. You will receive a confirmation email or SMS with details of when and where to pick up your parcel. Collect your parcel at your convenience. It will be held for 7 days at the local shop before being returned to our depot. Make sure to bring your order confirmation email/SMS and a valid form of personal identification.

During sale periods, please allow 7-14 days for your delivery. You will be advised of the estimated delivery date at the time of order.


8. Your Right of Withdrawal under Consumer Law

Under consumer law, if you are contracting with us as a consumer online or by phone, you have the right to cancel that contract within 14 days (subject to the exceptions listed below), without giving any reason for the cancellation (“Right of Withdrawal”). The cancellation period will expire 14 days from the day:

  • (a) on which you acquire, or a third party other than the carrier engaged to deliver the goods (at your request) acquires physical possession of the goods (in the case of a single order for goods delivered as part of a single delivery);
  • (b) on which you acquire, or a third party other than the carrier engaged to deliver the goods (at your request) acquires physical possession of the last of the goods (in the case of a contract relating to multiple goods ordered by you in one order and delivered separately);
  • (c) on which you acquire, or a third party other than the carrier engaged to deliver the goods (at your request) acquires physical possession of the last lot or piece (in the case of a contract relating to goods consisting of multiple lots or pieces); or
  • (d) on which you acquire, or a third party other than the carrier engaged to deliver the goods (at your request) acquires physical possession of the first of the goods (in the case of a contract relating to a regular delivery of goods during a defined period of time) (the “Cancellation Period”).

You may exercise your right to cancel by informing us, Next Germany GmbH, c/o BDO AG Wirtschaftsprüfungsgesellschaft, Zielstattstr. 40, D-81379 Munich, Germany, prior to the expiry of the Cancellation Period, by contacting us at 221168612, or by emailing us on this link, of your decision to cancel this contract (e.g. a letter sent by post or email). Alternatively, you may exercise your right to cancel by completing the Model Cancellation Form below.

We will communicate to you an acknowledgement of receipt of your cancellation statement, or your completed Model Cancellation Form, via email, without delay. For avoidance of doubt, such acknowledgement is not required to exercise your statutory rights. To meet the cancellation deadline, it is sufficient for you to send us your communication concerning your exercise of the right to withdraw, using one of the methods described above, before the Cancellation Period has expired. You may use the model cancellation form below if you wish to but you do not have to.

Effects of cancellation:
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than 14 days after the day on which we are informed about your decision to cancel this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event (including where you have agreed that the reimbursement may be made by a different means of payment to that used for the initial transaction), we shall ensure that you do not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall either: (a) send back the goods, or (b) hand the goods over to us (or, as the case may be, to a person authorised by us to receive them) without undue delay, and in any case not later than 14 days after the day on which you informed us of your decision to cancel of the contract. The deadline is met if you send back the goods before this period of 14 days has expired.

Please note that, where you have decided to cancel the contract, you are liable for any diminished value of the goods resulting from the handling of the goods beyond that which is necessary to establish the nature, characteristics, and functioning of the goods. Therefore, please take reasonable care of the relevant goods prior to returning them to us.

Exceptions to Right of Withdrawal:
Your Right of Withdrawal does not apply in the following circumstances:

  • contracts for the supply of goods that are not pre-fabricated, the production of which is governed by an individual choice of or decision by the consumer, or that are clearly tailored to personal needs of the consumer,
  • contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if such goods were unsealed after delivery,
  • contracts for the supply of goods which, according to their nature, are inseparably mixed, after delivery, with other items.

9. Next’s Returns & Refund Policy

This section sets out Next’s returns policy. This returns policy is in addition to your consumer rights, and does not limit, or affect, your legal consumer right to return goods, including your right of withdrawal (as defined in the “Right of Withdrawal” section above).

If you are not satisfied with the goods that you have purchased from Next using this Website, you may return any unworn items (in their original condition), within 28 days of receiving your order, for a full refund. Refunds will be processed within 14 days of Next receiving the returned goods, to the original payment method used to place your order. We cannot accept the return of sealed goods that are not suitable for return for health protection, and hygiene reasons, and which have been unsealed following delivery. This does not affect your consumer rights, for example where you purchase and receive goods which do not conform to the contract you entered into with us (e.g., if they are faulty, or don’t match the description provided by us (see the “Complaints” section, below)).

To return goods purchased online via post:
Please use the returns label provided on your delivery note. If you are exercising your right to cancel the contract in accordance with your Right of Withdrawal (see the “Right of Withdrawal” section, above), you must pay the cost of postage required to return the item to Next (as well as any additional reasonable costs which may be charged in accordance with law), and any such costs will not be refunded to you by Next. Simply return any unused item within 28 days of receipt for a full refund of the price of the goods (provided it is in a new, unused condition). You can return your items using your returns note and label included in your parcel. Please note that a shipping cost of 9 zł will be deducted from your refund.

Exceptions to the Returns Policy:
Returns policy, as stipulated in this section, does not affect your statutory right to cancel the contract in accordance with your Right of Withdrawal (as above). Also, it does not apply to goods purchased online from Next using this Website in respect of: (a) contracts for the supply of goods that are made to order, on the basis of your individual choice or decision; (b) contracts for the supply of goods that are clearly personalised; (c) contracts for the supply of sealed goods that are not suitable for return for health protection and hygiene reasons, and which have been unsealed following delivery; and (d) certain jewellery, cosmetics, grooming, photographic, or food products, and gift vouchers, where this is indicated at the point of purchase.


10. Sale Information

All Sale items are subject to availability. During sale periods, please allow 21 days for your delivery. You will be advised of the estimated delivery date at the time of order. During busy periods, we may restrict the number of items you can add to your shopping bag. When this happens, you will have the opportunity to remove items and complete your order.


11. Application and Account Details

If you create and use an account with Next, you are responsible for maintaining the confidentiality of your account and password and for restricting access to it. If you are under 18 years of age, you may only use the Website with the involvement of a parent or guardian. Minimum technical requirements to use the Website and creating an account include a device with Internet access, a modern web browser with TLS/SSL support, enabled cookies and JavaScript. Further, in order to create an account you need to an active email account. It is prohibited to provide unlawful content in relation with using the Website and services under the agreement. You may close your account and cease to use services available via the Website at any time.


12. Complaints

If you have a complaint, in particular with respect to services received or products purchased, please email International_Complaints@nextdirect.com. Next welcomes and learns from complaints. We aim to deal with complaints speedily and sympathetically. All complaints are logged, investigated and replied to. We will respond to consumer complaints without undue delay and no later than 14 days from receipt.

Non-conformity of goods with the contract:
Next is liable for lack of conformity of goods (products) ordered via the Website with the contract in accordance with the Polish Act of 30 May 2014 on Consumer Rights (”Consumer Rights Act”). You have the right to submit compliant related to the non-conformity of goods by email to International_Complaints@nextdirect.com. Main rules of Next’s ability are summarised below. For avoidance of doubt, it does not affect or alter, in any way, your rights granted under applicable laws, in particular the Consumer Rights Act.

Next is liable for lack of conformity which exists at the time when the goods were delivered and which becomes apparent within two years of that time. The product is deemed to conform with the contract in particular if: (i) it meets the description, specifications and other features in accordance with the contract, (ii) it fits for any particular purpose for which you require it and which you made known to us at the latest at the time of the conclusion of the contract, provided that Next accepted it, (iii) is delivered with all accessories and instructions, as stipulated by the sales contract, (iv) is suitable for the purposes for which it is normally used, taking into account applicable laws, technical standards or industry codes of conduct; (v) it is of the same quality and corresponds to the description of a sample or model that Next made available to you prior to the conclusion of the contract, (vi) it is delivered with accessories, including packaging and instructions that you may reasonably expect to receive, (viii) it possesses the qualities and other features normal for products of the same type and that can reasonably be expected taking into account the nature of the goods and the public assurances made by or on behalf of Next. There would be however no lack of conformity if Next at the time of the conclusion of the contract, specifically informs you that particular characteristic of the goods was deviating from the above and you expressly and separatelly accepted that deviation when concluding the contract.

If the goods do not conform with the contract, you may request Next, in accordance with Consumer Rights Act, to:

  • bring the goods into conformity by repair or replacement, free of charge, within a reasonable period of time and without any significant inconvenience;
  • receive a proportionate reduction in the price, or
  • terminate the contract (unless lack of conformity is only minor).

Next may refuse to bring the goods into conformity if repair and replacement are impossible or would impose costs on the seller that would be disproportionate.


13. Colour Reproduction

Next designers take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change. Nothing in this section limits your statutory rights regarding the conformity of goods with the contract.


14. Content

We are the owner or licensee of all intellectual property rights in the Website, including text, graphics, user interfaces, visual interfaces, illustrations, photographs, trademarks, logos and computer code, the design, structure, arrangement, selection, coordination, expression, and ‘look and feel’ of the Website (together, “Our Content”). All of these rights are protected by copyright and other intellectual property laws and treaties around the world. All rights are reserved to the relevant owner or licensee of those works. Your use of the Website and Our Content does not grant you any rights in relation to any of the intellectual property rights or other associated rights. You must not use any part of Our Content on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.


15. Credit Card Payments

You can choose from the available payment methods during and before completing the order process. You can pay with Amex, Apple Pay, Blik, Google Pay, PayPal, Klarna, Mastercard, Przelewy24, Visa. We are unable to accept credit cards that are due to expire within the next FIVE Days. Card details are checked and verified by a third party and goods are despatched once authorisation has been obtained.


16. Voucher PINs with Money or a Percentage Off on the Website

The offer is valid for orders over the minimum value stated in your communication. The offer is valid until the expiry date shown on your communication. The offer can only be activated once the voucher PIN has been registered at the Website. A voucher PIN can only be registered once. The offer can only be used for purchases made online at the Website. It is not valid for telephone transactions. Redemption of the offer involves registering at the Website. The offer is only valid on introductory orders on the Website for new customers only. One voucher PIN per customer only. If the order is returned, the value of the offer is non-refundable. The voucher PIN cannot be exchanged for cash. No change or refund will be given. Offer is open to residents of selected countries that are over 18 years old only. Your consumer rights are not affected.

Offer Order Codes: Free delivery and other offer order codes remain the property of Next, are non-transferable, and may not be reproduced in any form or used in conjunction with any other offer, unless expressly stated otherwise.


17. Force Majeure

It is possible that disturbances may arise when we deliver goods to you or when you return goods to us, due to force majeure events (i.e., events which are unforeseeable, unavoidable, beyond our control, and for which we are not responsible, such as war, natural disasters, floods, fires, pandemics, epidemics, or similar occurrences). During such events, agreed delivery periods shall be extended by the duration of such disturbance to the extent it prevents performance despite due care. This clause does not exclude or limit your statutory consumer rights. Where such disturbances arise, party which suffers them must inform the other party of such disturbance as soon as possible. Where the end of such a disturbance is unforeseeable, or where the disturbance lasts for more than two (2) months, either party has the right to withdraw from the contract concerned (or its services not yet fulfilled).


18. Governing Law & Jurisdiction

These Terms including any contracts concluded based on such Terms will be governed by and interpreted in accordance with the laws of the England and Wales. The parties hereby submit to the non-exclusive jurisdiction of the English courts. This means that you may also bring a dispute before the court competent for your place of residence. If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms including the paragraph above, affects your rights as a consumer to rely on such mandatory provisions of local law.

You may use out-of-court methods for handling complaints and redress procedures, in particular before permanent consumer arbitration court operating at the competent voivodeship inspectorate of the Trade Inspection or apply to the competent Voivodeship Inspector of the Trade Inspection for the initiation of mediation proceedings for out-of-court settlement of a dispute. Detailed information on out-of-court complaint handling and redress procedures may be found on the Polish competition and consumer protection authority’s (UOKiK) dedicated website: https://polubowne.uokik.gov.pl. Using out-of-court methods for handling complaints and redress procedures is voluntary and neither Next nor you is obliged to use them.
